These Terms & Conditions ("Terms") are a binding agreement between you and Sawadee Thai LLC. By accessing or using sawadeethai.club, its installable web application, a native Sawadee Thai mobile application, or a related Sawadee Thai service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not create an account or use the service.

Our in-product safety notices, upload confirmations, and community rules form part of these Terms. If a feature has additional terms presented before use, those additional terms also apply.

You may use Sawadee Thai only if you:

• Are at least 18 years old and legally able to enter this agreement
• Provide truthful age, identity, profile, and eligibility information
• Use your own account and maintain no more than one personal account unless we approve otherwise
• Are not prohibited from using the service by applicable law
• Have not previously been permanently removed unless we expressly authorize a return

You must not misrepresent your identity, age, gender, relationship intentions, location, affiliation, or verification status. We may require reasonable information to confirm eligibility or investigate suspected deception.

Verification is optional, but some features—including unrestricted messaging and translation—are limited to eligible verified accounts. To apply, you must provide truthful first and last names, date of birth, a supported government photo ID, a live selfie, camera access, and the consent shown in the verification flow.

Stripe Identity securely captures and retains the ID and selfie, checks the document, performs a liveness and face-match check, and returns verification results and available verified fields. Sawadee Thai's app does not download or store separate copies of the raw ID or selfie files in Firebase. After Stripe reports a successful verification with the required verified fields, Stripe's returned name and birth date become the authoritative verified account details. Gender is not part of identity verification and remains editable profile information. Pending, requires-input, canceled, rejected, or unavailable results remain unverified unless and until a later verification succeeds.

After successful verification, your verified first name becomes your public display name. Your legal last name and full birth date remain private. Your first name and date of birth become locked and may be changed only through an approved correction, appeal, or re-verification process. Gender remains editable profile information and is not certified by the verification badge. A verification badge is not a criminal-background check, endorsement, or guarantee of identity beyond the limited checks described, intentions, compatibility, conduct, or safety. We may reject, revoke, or require renewed verification for fraud, conflicting information, account recovery, material profile changes, safety concerns, or provider error.

Accounts use supported third-party providers rather than a Sawadee Thai password. Keep your provider account and device secure. You are responsible for activity performed through your account unless you promptly report unauthorized access.

Do not sell, rent, transfer, share, or allow another person to operate your account. Signing in on a new supported installation may end the prior active app session as an account-security safeguard. Notify us at sawadeethai.club@gmail.com if you suspect misuse. Your registered email and user ID are not editable profile fields.

Treat every person with dignity and respect, online and after meeting. You must not:

• Harass, bully, threaten, stalk, intimidate, shame, blackmail, coerce, or repeatedly contact someone who has set a boundary
• Promote hatred, dehumanization, or discrimination based on race, ethnicity, nationality, religion, disability, sex, gender identity, sexual orientation, age, or another protected characteristic
• Encourage violence, self-harm, terrorism, exploitation, trafficking, or dangerous or illegal conduct
• Sexually harass another person, send unwanted sexual content, request intimate images, or share non-consensual intimate material
• Exploit, sexualize, contact for romantic purposes, depict, or endanger a minor
• Dox, expose private information, track a person, or use location or profile data to find a home, workplace, or routine
• Impersonate a person or organization or operate a deceptive, fraudulent, or coordinated fake profile
• Solicit money, investments, gifts, financial credentials, commercial services, political support, or charitable donations from members
• Send spam, malware, scams, pyramid schemes, promotional links, or repetitive unwanted messages

Conduct outside Sawadee Thai may result in action when it creates a credible safety risk or shows that a member is unfit for the community.

You keep ownership of content you submit. You grant Sawadee Thai a non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize, crop, display, transmit, moderate, and otherwise process that content only as needed to operate, secure, improve, and promote the service within Sawadee Thai. This license ends when the content is deleted, subject to reasonable backup, cache, legal, and safety retention.

Public display names and language labels are limited to the information those fields request. Before publishing an update, our protected server checks formatting and rejects contact details, payment requests, promotions, and sexual or otherwise unsafe public-profile text. The check runs within our Firebase backend and does not send this profile text to OpenAI. A rejected attempt may create a short-lived restricted safety event containing a one-way hash and reason codes, not a copy of the rejected text.

You represent that you own your content or have all permissions, releases, and rights needed for us and other members to use it as described. Profile photos should be of you. Do not upload:

• A photo of another person without permission or an image you do not have the right to use
• Photos featuring minors, even if you are also present
• Nudity, sexual acts, graphic violence, illegal content, hidden-camera material, or non-consensual intimate images
• Private or identifying information such as addresses, identity documents, account numbers, or contact credentials
• Watermarked advertising, solicitation, malware, or misleading links
• Manipulated, AI-generated, or edited content used to impersonate or materially deceive others

We may remove or restrict content and respond to valid copyright, privacy, publicity, or safety complaints.

You must not:

• Scrape, crawl, index, copy, harvest, sell, broker, or compile profiles, photos, messages, or member data
• Use bots, scripts, browser automation, fake traffic, or unauthorized artificial intelligence to access or interact with the service
• Reverse engineer, probe, bypass, disable, overload, or interfere with security, rate limits, permissions, App Check, or access controls
• Upload malicious code or attempt to access another account, private record, system, or credential
• Use Sawadee Thai to train facial-recognition, surveillance, generative-AI, or identity-resolution systems
• Resell the service or use member data for advertising, research, recruiting, law enforcement surveillance, background checks, or commercial purposes without written authorization

Ordinary use of accessibility technology is allowed and welcomed.

Meeting people involves risk. Sawadee Thai does not conduct a comprehensive criminal, identity, or sex-offender background check on every member and does not guarantee that profile information, verification status, translations, intentions, or conduct are accurate or safe. A verification badge is not an endorsement, identity warranty, or safety guarantee.

Never send money, financial information, passwords, identity documents, intimate images, or security codes. Keep early conversations in the app. Meet first in a populated public place, control your transportation, tell a trusted person your plans, protect your drink and belongings, and leave if uncomfortable. Consent must be voluntary, informed, specific, and ongoing; it may be withdrawn at any time.

Call 911 or the appropriate local emergency service for immediate danger. Report suspicious, abusive, underage, fraudulent, or unsafe behavior to Sawadee Thai.

Chat is text-only. Messages and requested translations expire 24 hours after creation and are automatically removed shortly after expiry. Conversations cannot be manually deleted, and inactive conversation-list entries are archived after about six months without a new message.

Unverified accounts may send one message of up to 50 characters every five minutes. Eligible verified accounts receive expanded messaging and may request machine translation. We may apply reasonable anti-spam and safety rate limits to all accounts.

Translation may be inaccurate and must not be used to establish legal consent or make emergency, medical, legal, or financial decisions. Do not use disappearing messages to evade these Terms; report snapshots and limited safety records may be preserved when a report or legal duty requires it.

You can report a profile, conversation, or paid advertisement and block another account. Submit truthful, relevant information; intentionally false, retaliatory, or abusive reports violate these Terms.

A report may preserve a limited snapshot of the reported profile, report details, identifiers, and relevant safety context so it can be reviewed even if the profile later changes or content expires. Blocking prevents normal interaction and profile access but does not erase reports or evidence.

Advertisement reports preserve the campaign identifier, business name, destination, image reference, and report details available when submitted. Reporting does not guarantee immediate removal, but we may pause or cancel a campaign while reviewing safety, legality, accuracy, or destination concerns.

We may review available information, request clarification, remove content, warn, restrict, suspend, or permanently ban accounts, preserve evidence, and contact appropriate authorities when reasonably necessary. We do not promise a particular outcome or disclose confidential moderation, reporter, or security information.

Account status and account standing are separate. An account may be active while carrying a warning. Depending on severity, context, history, and risk, enforcement may include education, content removal, feature restrictions, a warning or strike, suspension, or permanent removal. A serious violation may result in immediate permanent removal without a prior warning.

Sawadee Thai's current strike model may issue a warning for a first qualifying violation and a permanent ban for a second; this does not limit our ability to act immediately for severe misconduct, fraud, exploitation, threats, or legal requirements. We may prevent a removed person from creating another account.

To request review of an enforcement decision, contact sawadeethai.club@gmail.com with the registered email and relevant details.

Businesses may inquire about promotion availability by emailing sawadeethai.club@gmail.com. An inquiry must include the business legal name, an authorized contact name and email address, the website destination, a truthful business bio, and a marketing image that is exactly 1024 × 1024 pixels. Proposed timing and payment are agreed in writing before a campaign begins. Payment does not guarantee approval, placement, impressions, clicks, sales, or any other result.

The advertiser represents that it is legally authorized to operate, owns or has permission to use every submitted name, logo, image, trademark, statement, and destination, and that all claims are truthful, current, non-deceptive, appropriately substantiated, and compliant with applicable law. Sawadee Thai may request reasonable business, licensing, identity, ownership, or claim-substantiation information during review. Approval confirms only that the submitted campaign passed our review at that time; it is not an endorsement or guarantee of the business.

We do not accept promotions for illegal goods or services; adult or sexually explicit content, pornography, escort services, or sexual services; gambling, betting, lotteries, sweepstakes structured as gambling, or gambling-promoting services; weapons, explosives, recreational drugs, alcohol, tobacco, vaping, or dangerous products; counterfeit goods; hate, violence, exploitation, trafficking, or discrimination; malware, phishing, surveillance, credential collection, or dishonest behavior; deceptive financial schemes, predatory lending, unrealistic earnings claims, or fraudulent fundraising; political campaigning; or any content or destination we reasonably consider unsafe, misleading, exploitative, unlawful, or inconsistent with this community. Regulated health, financial, or other sensitive promotions may be rejected or require additional proof and disclosures.

Approved content and its destination must remain materially the same throughout the campaign. Redirecting the approved URL, replacing destination content, changing the offer, concealing material terms, making misleading claims, or otherwise altering the promotion after review without our prior written approval will result in immediate suspension or cancellation. We may also suspend or cancel a campaign if the business, content, destination, payment, or conduct violates these Terms, law, member safety, or the written campaign agreement. Refund eligibility, if any, follows the written agreement and applicable law.

Sawadee Thai, its heart logo, interface, software, text, graphics, and service features are owned by Sawadee Thai LLC or its licensors and protected by law. These Terms give you a limited, personal, revocable, non-transferable, non-exclusive right to use the service for lawful personal dating purposes.

If you believe content infringes your copyright or other rights, email sawadeethai.club@gmail.com with your contact information, identification of the work or right, the location of the material, a good-faith explanation, and a statement that the information is accurate. We may request additional information before acting.

Sawadee Thai relies on third parties for authentication, hosting, security, translation, maps or geocoding, and payment checkout. Their services may be governed by separate terms and privacy policies. We are not responsible for a third-party service outside our control.

Disconnecting or deleting a provider account may affect your ability to sign in. Voluntary support purchases are processed by Apple in the native iOS app and by Stripe on the website. They do not purchase verification, matches, visibility, or account privileges. Contributions are not charitable or tax-deductible donations and are refundable only when required by law or the applicable App Store or checkout terms.

We may add, remove, test, limit, suspend, or discontinue features to improve safety, comply with law, address abuse, or operate the business. Features described as "coming soon" are not promised by a particular date.

We do not guarantee uninterrupted availability, a minimum number or quality of profiles, matches, responses, translation results, compatibility, or a particular relationship outcome. You are responsible for maintaining a compatible device, browser, network connection, and provider account.

You may stop using the service and schedule account deletion at any time. Login and profile visibility are disabled immediately, followed by a 30-day waiting period. During that period, cancellation is available only through a verified request sent to sawadeethai.club@gmail.com. Once backend deletion completes, it is irreversible. We may restrict, suspend, or terminate access when reasonably necessary to enforce these Terms, protect people or the service, respond to legal requirements, or address operational risk.

Provisions that by their nature should survive termination—including content rights needed to complete deletion, safety and evidence preservation, intellectual property, disclaimers, limitations, disputes, and legal obligations—continue to apply.

To the fullest extent permitted by law, Sawadee Thai is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant the identity, statements, intentions, compatibility, conduct, safety, legality, or health of any member or the accuracy of machine translation or location estimates.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

You are responsible for your interactions and decisions, including meetings outside the service. To the fullest extent permitted by law, Sawadee Thai LLC and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, loss of goodwill, or harms arising from another member's conduct or unauthorized access.

These limitations do not apply to liability that cannot be limited under applicable law, including where applicable liability for fraud, willful misconduct, gross negligence, or personal injury caused by our legally established fault.

Before filing a formal claim, please contact sawadeethai.club@gmail.com so we can try to resolve the issue informally. These Terms are governed by California law, without regard to conflict-of-law rules, except where the consumer law of your home jurisdiction must apply.

Unless applicable law gives you another right, disputes will be brought in a court of competent jurisdiction in California. These Terms do not require arbitration and do not waive a right to bring an eligible claim in small-claims court.

If a provision is unenforceable, it will be limited or removed only to the extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not transfer this agreement without our written permission; we may transfer it as part of a merger, financing, reorganization, or sale of the service, subject to law.

These Terms and the policies incorporated into them are the complete agreement about your use of Sawadee Thai and replace prior versions on the effective date.

We may revise these Terms to reflect legal, safety, product, or operational changes. We will change the effective date and give notice or request renewed agreement when legally required for a material change. Continuing to use the service after revised Terms take effect means you accept them, unless law requires a different form of consent.
